1. Scope & Operator

These Terms & Conditions apply to all orders placed through www.frauleinkink.com. The operator of this online store is Fräulein Kink, Berlin, Germany — contact@frauleinkink.com. By placing an order or using this website, you agree to these Terms & Conditions. By placing an order, you confirm that you are at least 18 years of age and legally permitted to purchase and possess the products offered on this website.

2. Conclusion of Contract

The presentation of products on this website does not constitute a legally binding offer. A binding purchase contract is concluded only when Fräulein Kink confirms your order by email or begins production of your item. We reserve the right to refuse orders for legitimate reasons, including suspected fraud, pricing errors, or inability to fulfil the order.

3. Made-to-Order Goods

All items sold through frauleinkink.com are individually handmade to order. No stock is held. Every item is produced individually upon receipt of a confirmed order. Average production time is 1–2 weeks depending on the complexity of the order. Laser-cut items may take up to 2–3 weeks. Production times are estimates and not guaranteed delivery dates. You will be notified by email if there is a significant delay to your order.

4. Prices & Payment

All prices displayed on this website are inclusive of applicable German VAT (Mehrwertsteuer) where required. For international orders, additional import duties and taxes may apply and are the responsibility of the customer, unless otherwise stated at checkout. Payment is due in full at the time of ordering. We accept payment methods as displayed at checkout. Items are not reserved or produced until payment is confirmed.

5. Shipping & Delivery

Orders are dispatched after production is complete. Estimated shipping times vary by destination and are provided at checkout. We ship on business days (Monday–Friday), excluding German public holidays. We are unable to ship to PO Box or military addresses. 6. Right of Withdrawal & Returns

All items offered in this shop are produced individually after receipt of order (made to order). No stock is held. The statutory right of withdrawal is excluded on the following grounds:

Pursuant to § 312g Abs. 2 Nr. 1 BGB and Art. 16(c) of EU Directive 2011/83/EU: goods are manufactured to order and begin production immediately upon order confirmation, rendering them specific to each individual transaction.

Pursuant to § 312g Abs. 2 Nr. 3 BGB and Art. 16(e) of EU Directive 2011/83/EU: all items are intimate apparel and body-contact goods that are not suitable for return for hygiene reasons once delivered. Customers are expressly informed of this exclusion prior to placing an order, on product pages and at checkout.

7. Production Commencement

By placing an order, the customer expressly agrees that production of their item will commence immediately upon order confirmation. The customer acknowledges that this constitutes the beginning of performance and that the right of withdrawal is thereby forfeited.

8. Defects & Warranty

If you believe your item contains a manufacturing defect, please contact us within 14 working days of receipt. We will assess the issue and, where a defect is confirmed, will seek to resolve it through repair, replacement, or another appropriate remedy in accordance with applicable law.

Due to the bespoke nature of their materials and the made-to-order production process, items made from Python Leather or Laser Cut Leather are non-returnable except where required by applicable law.

Statutory warranty rights (Gewährleistungsrechte) remain unaffected by these Terms & Conditions.

9. Retention of Title

All goods remain the property of Fräulein Kink until full payment has been received and cleared.

10. Gift Cards

Gift cards purchased through frauleinkink.com are valid for use on future orders placed through this website. Gift cards have no cash value and cannot be refunded or exchanged for cash. Gift cards do not expire. Lost, stolen, or unauthorised use of gift cards cannot generally be replaced or refunded. The statutory right of withdrawal does not apply to gift cards once they have been redeemed.

11. Liability

Fräulein Kink accepts liability for damages caused by intent or gross negligence. Liability for slight negligence is excluded except in cases involving injury to life, body, or health, or breach of a material contractual obligation (Kardinalpflicht). Nothing in these Terms excludes or limits liability where such exclusion is prohibited by law.

The buyer assumes full responsibility for safe and appropriate use of all products. Fräulein Kink accepts no liability for injury or damage resulting from misuse of products.

Some visual content on this website, including marketing and editorial imagery, may be digitally generated or enhanced using artificial intelligence tools. Such imagery is intended for illustrative purposes only and does not represent real persons. All products depicted are real, handmade items available for purchase.

12. Force Majeure

We shall not be liable for delays or failure to perform resulting from events beyond our reasonable control, including natural disasters, pandemics, labour disputes, transport disruptions, government actions, or supply shortages. We will notify you as soon as reasonably possible and work to fulfil your order when circumstances allow.

13. Intellectual Property

All content on this website — including text, photography, video, and graphic imagery — is the exclusive property of Fräulein Kink and is protected by copyright. Reproduction, distribution, or use of any content without prior written permission is prohibited.

14. Data Protection

The collection and processing of your personal data is governed by our Privacy Policy, which complies with the EU General Data Protection Regulation (DSGVO / GDPR). We do not sell or share your personal data with third parties except as required to fulfil your order (e.g. shipping providers).

15. The Private Atelier

The Private Atelier is an independent subscription service operated by Fanvue. This website (frauleinkink.com) serves solely as a marketing and information page for that service. The subscription contract is concluded exclusively between you and Fanvue Ltd — not with Fräulein Kink. Fräulein Kink is not a party to that contract and accepts no liability for the availability, content, billing, or cancellation of the Fanvue subscription. Cancellation of the subscription must be handled directly through your Fanvue account settings. For all matters relating to the Fanvue subscription — including billing disputes, cancellation, and data privacy — please refer to Fanvue's own Terms of Service and Privacy Policy.

16. Dispute Resolution

We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) and do not voluntarily participate in such proceedings. 17. Governing Law

These Terms & Conditions are governed by the laws of the Federal Republic of Germany. The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded. For consumers within the EU and UK, mandatory consumer protection provisions of your country of residence remain unaffected. Place of jurisdiction for merchants (Kaufleute) is Berlin, Germany.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
